Terms and Conditions of Service
These Terms and Conditions serves as an agreement between you and Swift Property Services relating to the use of our website and services.
Please take some time to review these terms as your engagement with our services constitutes an agreement to be bound by these Terms.
Client Obligations
When you engage with our services, you agree to the following terms and conditions:
- Will grant SPS and its employees right of access to the premises and to all services and utilities which may be reasonably required for the purpose of the provision of the services.
- Will ensure that any place in which an SPS representative is to work is reasonably safe from physical and/or health hazards and any other hazards that may be found on the site, and will inform you of, and take all reasonable and necessary actions to avoid, control or reduce hazards presented at the workplace.
- Will accept responsibility to SPS for payment of any and all charges relating to services rendered, or any cancellation, debt collection, or other fees as applicable.
You agree that if SPS comes to perform the services and you have not fulfilled your duties herein this section, SPS may then consider whether it is appropriate that SPS provides the aforementioned services.
If SPS determines that it will not be fit for SPS to offer our services as a consequence of your breach of your responsibilities under this section, you shall be bound to pay an administrative and traveling cost cancellation fee besides the fact that SPS shall not be held liable for any services not offered or completed.
Stains and Pre-existing Damage
On our part, SPS representatives accept to exercise due care and faithfully discharge our responsibilities. However, some stains do create irreversible effects and, thus, cannot be expected to be removed or reversed by our service, and we do not give any related assurances.
If our technician is unable to remove staining, the customer will not be charged and the technician will be happy to discuss other options with the customers.
There are certain situations, when there already is damage, certain problems hidden beneath the surface, or when the stain has been treated before – then cleaning may lead to further harm. Any such risk may not be easily discernible to our technician before undertaking; all services are delivered in the best of intentions. You hereby expressly acknowledge and agree that, in this regard, you will not have any recourse against us.
Industrial Cleaning Solutions
The cleaning process may also involve the use of industrial cleaning solutions to the best judgment of SPS representatives where necessary.
If you do not wish industrial cleaning solutions used, you may ask for the use of only environmentally friendly cleaning products or no cleaning products at all and it remains your responsibility to communicate to your SPS representative.
You agree that these options may significantly lower the chances of enhancing the appearance of staining or eradicating odors and you will not look to SPS for redress in this regard.
Furniture
It is the customer’s responsibility to pack and unpack fragile items, electrical items, large and heavy items and SPS technicians will not move such items.
You recall that any wooden or metal items have to be removed from the carpet until such time that the carpet is thoroughly dry as accidents may happen leading to damage to both the carpet and furniture. You agree and understand that if you decide to walk, drag, or roll furniture onto the carpet when it is wet or remains slightly damp SPS will not be held liable for any damages caused.
Prices
SPS also retains the right to decline any quote or change any quote at any time prior to your acceptance of the same.
Quotes on services by SPS are given depending on the information one has given. You acknowledge that if you fail to supply us with all the relevant information that we may require from you, then the accuracy of the quote that we give you may be affected and therefore our quote may need to be adjusted.
We know that sometimes things can be altered and we shall try in every possible way to effect the changes as per your wish.
This we do in good faith and you will be required to meet any extra costs where you ask your SPS technician to clean other areas or objects that were not agreed in the quote.
Payment
You hereby endorse that you have authorised the transaction and hold yourself personally liable to SPS for paying all fees incurred for services performed.
Cancellation
Either party may terminate the services by giving a notice of forty-eight (48 hours) prior to the performance of any of the services as may be provided by SPS.
You know that if you decide to cancel SPS’s services, with less than 48 hours, you’ll be charged a cancellation penalty for cost and otherwise.
Exclusion of Liability
The customer shall not be entitled to claim for any loss, costs, expenses or damage suffered by the customer or any third party flowing from any act or omission of SPS or any SPS representative where such act or omission was outside the reasonable control of SPS.
It also directs that SPS will not be responsible for any indirect, consequential, or special loss, damage, cost, or expense of any kind which you may sustain or incur in connection with these Terms.
Complaints
By employing the services of Swift Property Services, you acknowledge that it is your responsibility to report any grievance to SPS within 48 hours after the service delivery.
This is to afford SPS the opportunity to review the work done. In case you have not contacted SPS within this time or you have not given SPS timely access to the property in order to be able to assess and fix any concerns then it may be that SPS cannot fix your concerns, and you agree to release and indemnify SPS in this regard.
Privacy
You agree that during the delivery of the services that SPS will obtain your personal information and process the information in accordance with SPS’s Privacy Policy.
Amendment of Terms
We also retain the right to alter these Terms at will and do not have to provide any explanation for the alterations we make.
Any such changes shall take effect immediately and affect all subsequent use of the Service and the Website, and therefore you are required to check these terms regularly and before engaging with the services.
